Doctor continues with vaginal delivery despite shoulder dystocia

In this case, during labor the baby became stuck in the birth canal.  This is a complication known as shoulder dystocia.  In an attempt to complete a vaginal delivery the doctor tore the baby’s brachial plexus nerves leaving the baby with a permanent injury to his arm.  In addition, while time went by as the doctor worked to complete a vaginal delivery, the baby was suffering from a lack of oxygen – a fact that showed up in the readings from the fetal heart rate monitor.  The mother suffered unnecessary pain and scarring due to the severe tearing from the delivery.  The law firm that handled this birth injury case reported a settlement with a $1.3 Million present value.
